Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ad Clanker (adclanker.com), operated by Ad Clanker (“we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Ad Clanker is an AI-powered platform that generates short-form video advertisements from your website URL. We use third-party AI models including Anthropic Claude (script generation), FAL AI (image synthesis), and Seedance (video generation) to produce your ads.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Ad Clanker. By using the service, you represent that you meet these requirements. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Account Registration

You must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at hi@adclanker.com if you suspect unauthorised access.

4. Acceptable Use

You agree not to use Ad Clanker to:

Advertise illegal products, services, or activities
Create ads featuring non-consensual depictions of real people
Generate sexually explicit, hateful, or violent content
Impersonate other businesses or individuals, or misrepresent your identity
Violate any applicable advertising laws or platform policies (TikTok, Meta, YouTube, etc.)
Circumvent usage limits or access controls
Reverse-engineer, scrape, or abuse the platform
Use the service to train competing AI models

We reserve the right to remove content or suspend and terminate accounts that violate these rules, at our discretion, without notice.

5. Content You Submit

By submitting a website URL, actor images, product photos, or other content (“Input”), you represent that you own or have all necessary rights to use that content, and that it does not infringe any third-party rights (including intellectual property, privacy, or personality rights). You retain ownership of your Input.

You grant Ad Clanker a limited licence to process your Input solely to provide the service. We do not sell your Input or use it to train AI models without your explicit consent.

6. AI-Generated Output

Subject to your compliance with these Terms, you own the video ads and other content generated from your Input (“Output”). You are solely responsible for ensuring your Output complies with applicable laws, advertising regulations, and platform policies before publishing or distributing it.

AI-generated content may occasionally be inaccurate, unexpected, or unsuitable for publication. Review all Output before use. We make no representations about the accuracy, originality, or fitness of any Output.

We do not guarantee that Output will be unique or free from similarity to content generated for other users.

7. Payments and Billing

Paid plans are billed through Stripe. By subscribing or making a one-time purchase, you authorise us to charge your payment method. All prices are in USD. Applicable taxes may be added depending on your location.

Ad slots are consumed when a video is successfully generated. If generation fails due to a platform error, your slot is automatically refunded to your account.

8. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. Unused ad slots do not carry over to a new period and are forfeited upon cancellation.

9. Refunds

One-time purchases (First Ad, $39) are non-refundable once the ad has been generated. Subscription refunds are considered on a case-by-case basis — contact hi@adclanker.com within 7 days of being charged. We do not offer prorated refunds for mid-period cancellations. 10. Third-Party Services

The service relies on third-party providers including Google Firebase, Stripe, Anthropic, FAL AI, and Resend. Your use of Ad Clanker is also subject to their terms and privacy policies. We are not responsible for interruptions, errors, or data handling by third-party providers.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AD CLANKER’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO AD CLANKER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Ad Clanker and its officers, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your Input, your Output, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately. We are not liable for any loss resulting from termination. Sections 5, 6, 11, 12, 13, and 15 survive termination.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

16. Modifications

We may update these Terms at any time. We will notify you by email or by posting a notice on the site at least 7 days before changes take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
